Terms of Service

Before using the services provided by Reservalue (the system services under the domain reservalue.net, hereinafter referred to as "the Service"), please read the following terms (hereinafter referred to as "the Terms") carefully and agree to be bound by them and applicable laws. The Terms form part of the agreement between you and Reservalue Ltd. (hereinafter referred to as "the Company"). If you do not agree to the Terms, or if your country or region excludes all or part of the Terms, please stop using the Service immediately.

Definitions

Member: A person who has registered for the Service. Upon successful registration, the member will have access to the corresponding system features.
Member Data: The member's email, name, phone number, and other data that can directly or indirectly identify the member.
Reservation Page: The reservation page and related settings created by the member through the Service.
Customer: Any person who views a member's reservation page or makes a reservation.
Reservation: The data created after a customer completes a reservation through the reservation page, including time, items, customer contact information, pre-visit questionnaire, etc.

Responsibilities and Obligations of Becoming a Member

By registering a Reservalue account and becoming a member, you acknowledge and agree to the following:

  1. You must be a natural person aged 18 or older, or a legally registered company or legal entity, and have understood and agreed to all the terms of this Terms of Service (including any amendments).
  2. During your use of the Service, you must keep your member data up to date. If you provide any false or incomplete information, the Company reserves the right to suspend or terminate your account and refuse your use of the Service.
  3. The Service may incur fees as agreed. If you fail to pay service fees by the due date, resulting in your inability to use the Service, you shall bear sole responsibility and may not claim any compensation from the Company.

You agree that you will not use the Service for any illegal purpose or in any illegal manner, and you warrant compliance with the laws of the Republic of China (Taiwan) and international conventions for internet use. You also agree and warrant that you will not use the Service to engage in activities that infringe upon the rights of others or are otherwise unlawful, including but not limited to:

  1. Uploading, posting, publishing, or transmitting any defamatory, insulting, threatening, offensive, obscene, indecent, false, or content that violates public order or good morals, or any other unlawful text, images, or files to the Service.
  2. Uploading, posting, publishing, transmitting, or distributing any data containing computer viruses or any code that may interrupt, destroy, or limit the functionality of computer software or hardware.
  3. Infringing upon others' reputation, privacy, trade secrets, trademarks, copyrights, patents, other intellectual property rights, or other rights.
  4. Violating confidentiality obligations imposed by law or contract.
  5. Engaging in illegal transactions or posting false or misleading information that may incite criminal activity.
  6. Selling firearms, drugs, prohibited substances, pirated software, or other contraband.
  7. Providing gambling information or inducing others to participate in gambling in any way.
  8. Sending spam emails, junk mail, chain letters, or illegal multi-level marketing messages.
  9. Harming minors in any way.
  10. Forging message sources or interfering with the identification of transmission sources in any way.
  11. Interfering with or disrupting the Service, the Company's servers, or networks connected to the Service.
  12. Providing any material support or resources for terrorist activities.
  13. Collecting or storing personal information of others for the purpose of stalking or harassing them.

If you are a user outside the Republic of China (Taiwan), you must also agree to comply with the relevant laws and regulations of your country or region.

Responsibilities and Obligations of Using the Service

By using the Service to create reservation pages for customers to browse and make reservations, you acknowledge and agree to the following:

  1. You must serve customers under your own name or the name of a legal entity or company you are authorized to represent. You may not impersonate others.
  2. You must pay the applicable fees for your use of the Service as agreed.
  3. You must clearly inform customers through the reservation page that the service they are reserving is provided by you.
  4. You are responsible for all obligations arising from reservations created through the Service, including attendance, absence, rescheduling, cancellation, payment and refund processing, and communication with customers. The Company will not intervene in your business dealings with customers. Any disputes between you and customers or third parties are unrelated to the Company.
  5. You must comply with the Personal Data Protection Act when collecting or using customers' personal data, including but not limited to names, email addresses, phone numbers, addresses, and message content. If you violate relevant regulations and incur civil or criminal liability, the Company shall not be held responsible, and you must ensure the Company suffers no damage as a result.
  6. The Company may indicate on appropriate pages that the system service is provided by Reservalue.

Regarding all "businesses," "services," and "items" and their related labels and content that you create through the Service, you acknowledge and agree to the following:

  1. You must warrant that all "businesses," "services," "items," and their related labels and content created through the Service comply with the Consumer Protection Act, Fair Trade Act, Act Governing Food Safety and Sanitation, Commodity Labeling Act, Commodity Inspection Act, and other relevant laws. The Company may request that you provide original documents or other documents deemed sufficient by the Company to prove that your "businesses," "services," "items," and their related labels and content comply with relevant laws.
  2. You must warrant that all "businesses," "services," "items," and their related labels and content created through the Service do not infringe upon others' copyrights, patents, trademarks, intellectual property rights, or other rights, and do not violate any laws. If disputes arise from the above matters, you shall be responsible for resolving all arising issues and shall bear all liability, and you must ensure the Company suffers no damage.
  3. You must warrant that the right to perform all "businesses," "services," and "items" and their related labels and content created through the Service is indeed yours, and you provide appropriate customer support services.
  4. You are responsible for all obligations arising from reservations created through the Service, including attendance, absence, rescheduling, cancellation, payment and refund processing, and communication with customers. The Company will not intervene in your business dealings with customers. Any disputes between you and customers or third parties are unrelated to the Company.

Actions Taken Upon Violation of Terms

  1. In the event of a consumer dispute, you shall handle it promptly. If you fail to properly handle a consumer dispute, resulting in the Company being penalized by a government agency, or being subject to any claim, lawsuit, or government complaint by a third party, you shall provide necessary explanations and assistance at the Company's request, promptly handle and resolve the matter, and ensure the Company suffers no damage.
  2. If you violate the warranties or obligations of the Terms and cause damage to the Company, you acknowledge your responsibility to compensate for damages (including but not limited to attorney fees and lost profits).

Disclaimer

During the period in which Reservalue provides the Service to you, you have the right to continue or stop using the Service as you see fit. If you choose to continue using the Service, the Company does not warrant the following:

  1. The Service will meet your requirements.
  2. The Service will be error-free, completely secure, or always accessible.
  3. The results of using the Service will always be accurate and as expected.
  4. Software errors in the Service will always be corrected.
  5. Errors in the Service will always be corrected.

Interpretation and Amendment of Terms of Service

To ensure that the Terms of Service comply with local regulatory requirements and market needs, the Company reserves the right to amend the Terms at any time. Amendments will take into account the interests of both you and the Company. You may revisit this page at any time to review the latest version of the Terms of Service. If you do not raise any objections, you are deemed to have accepted and agreed to the amended Terms.
